By accessing or using InstaWebsite's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

InstaWebsite is a trading name of Codemind LTD, a company registered in England and Wales.

2. Description of Services

InstaWebsite provides website design, development, hosting, and maintenance services for small businesses in the United Kingdom. Our standard service includes:

• Custom website design and development
• Web hosting on our managed platform
• One free .co.uk domain registration (new registrations only)
• SSL security certificate
• Unlimited content updates (text, images, minor changes)
• UK-based support
• Regular maintenance and security updates

3. Free Trial Period

We offer a 10-day free trial period for new customers. During this period:

• Your website will be designed, built, and made live
• No payment is required during the trial period
• You may cancel at any time within the 10-day trial for £0
• If you do not cancel, your subscription begins automatically on day 11

4. Subscription and Payment

4.1 Pricing

Our standard website subscription is £19.99 per month. This price includes all services listed in Section 2.

4.2 Billing

• Subscriptions are billed monthly in advance
• Payment is processed automatically via Stripe
• Invoices are sent via email
• All prices are in GBP and include VAT where applicable

4.3 No Minimum Term

After your 10-day free trial, there is no minimum term. You may cancel at any time with 30 days notice. We believe in earning your business every month.

4.4 Failed Payments

We understand that missed payments happen, and we will always work with you rather than against you. If a payment fails, we will reach out personally to understand the situation and help you resolve it. We will never suspend your website without speaking to you first. We treat our customers like family — if you are going through a difficult time, talk to us and we will do our best to support you.

5. Cancellation

5.1 During Free Trial

You may cancel at any time during your 10-day free trial with no charge. Your website will be taken offline immediately.

5.2 After Free Trial

After your free trial, you may cancel at any time with 30 days notice. Your website will remain live until the end of your paid period.

5.3 Effect of Cancellation

Upon cancellation:

• Your website will be taken offline
• Your content (text, images) remains your property
• We will provide your complete website code, files, and assets upon request at no charge
• The domain may be transferred to you (subject to registrar transfer fee, typically under £10)

6. Website Ownership and Portability

6.1 Content Ownership

All content you provide (text, images, logos, branding) remains your property from day one.

6.2 Website Code and Portability

Your website code and design are hosted on our managed platform while your subscription is active. If you decide to leave, we will export and hand over your complete website — all code, design files, images, and content — at no charge. The only cost is the domain registrar transfer fee (typically under £10), which is set by the registrar, not by us.

Once your website code is delivered to you (whether during or after your subscription), you have full ownership and the right to use, modify, and host it as you see fit.

7. Content Updates

7.1 Included Updates

Your subscription includes unlimited minor content updates, such as:

• Text changes and corrections
• Image swaps (within existing layout)
• Price updates
• Contact information changes
• Adding/removing services from existing pages

7.2 Additional Work

Major changes may be quoted separately, including:

• Complete page redesigns
• Adding multiple new pages
• New functionality or features
• Major structural changes

We will always provide a quote before undertaking additional work.

8. Acceptable Use

You agree not to use our services to:

• Publish illegal, harmful, or offensive content
• Infringe on intellectual property rights
• Distribute malware or engage in phishing
• Send spam or unsolicited communications
• Misrepresent your business or services
• Violate any applicable laws or regulations

We reserve the right to suspend or terminate services for violations of this policy.

9. Service Availability

We strive to maintain 99.9% uptime for all hosted websites. However, we cannot guarantee uninterrupted service and are not liable for:

• Scheduled maintenance (we will provide advance notice where possible)
• Third-party service outages (domain registrars, CDNs)
• Events beyond our reasonable control

10. Limitation of Liability

To the maximum extent permitted by law, InstaWebsite shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Any damages exceeding the total fees paid in the 12 months prior to the claim

This does not affect your statutory rights as a consumer.

11. Intellectual Property

You warrant that all content you provide for your website:

• Is owned by you or you have the right to use it
• Does not infringe on any third-party rights
• Does not violate any applicable laws

You agree to indemnify us against any claims arising from your content.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by email or through our website. Continued use of our services after changes constitutes acceptance of the new terms.

13. Governing Law

These Terms of Service are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
